Accept Special Warranty Deed from Hartford Terrace Community Development District, for additional rights-of-way along Forest Lake Drive and Holly Hill Road. (No fiscal impact)

DESCRIPTION
Pulte Home Company, LLC is the developer of a residential subdivision known as Hartford Terrace Phase 1 located to the east of US Highway 27 in Davenport. A plat for Hartford Terrace Phase 1 was recently approved by the City of Davenport and subsequently recorded in Plat Book 202, at Pages 44 through 48, Public Records of Polk County. The development lies adjacent to Forest Lake Drive and Holly Hill Road which are both county-maintained roadways. Due to the fact that the existing rights-of-way for said County roadways are not up to current county road classification standards a right-of-way tract identified as Tract RW-1 was retained by the developer and, based on language contain in the plat, was to be conveyed to the Hartford Terrace Community Development District (“CDD”) and then conveyed to Polk County. Tract RW-1, along with various other tracts, was recently conveyed to the CDD by the developer and the CDD has executed and delivered a Special Warranty Deed to the County for the above-mentioned tract. Accepting the Special Warranty Deed will give the County the right-of-way needed to upgrade the existing rights-of-way for Forest Lake Drive and Holly Hill Road, lying adjacent to the development, to meet current road classification standards.
RECOMMENDATION
Request Board accept the aforementioned Special Warranty Deed.
