DESCRIPTION

Floyd Road a/k/a Kennedy Road, Hughes Road and Palmeroy Road are County maintained roadways which lie within, or adjacent to, the municipal limits of the City of Haines City (the “City”).  Floyd Road a/k/a Kennedy Road and Palmeroy are classified as Local Residential roadways and Hughes Road is classified as an Urban Collector roadway.  Floyd Road a/k/a Kennedy Road and Palmeroy Road in their entirety and Hughes Road from Palmeroy Road east to the former railroad corridor (hereinafter collectively the “Roads”) are proposed to be transferred to the City in conjunction with proposed residential development in the area. 

 

Florida Statutes allow for the transfer of public roads between jurisdictions by mutual agreement of the affected governments and a conveyance of the associated right-of-way by deed. The City has reviewed and approved, at its meeting held August 18, 2022, the Agreements for Transfer of Public Roads and has agreed to accept the County Deeds for the associated rights-of-ways.  Approving said Agreements and authorizing the County Deeds to the City for the associated rights-of-ways will transfer ownership of the Roads and will remove the roadways from the County’s road inventory thereby allowing the County to cease maintenance and future liability responsibilities associated with them.

 

RECOMMENDATION

Request Board approve the aforementioned Agreements for Transfer of Public for the Roads and authorize the County Deeds to the City for the rights-of-ways associated therewith.

There is no fiscal impact associated with this agenda item.
