DESCRIPTION

Polk County is the record owner of real property at 3801 Camp Lester Road (Camp Lester Fire Station), Lake Wales, Fl 33853-9752. Polk County received a quit claim deed from Kissimmee River Volunteer Fire Station, Inc. on February 5, 1979, and recorded in Official Records Book of Polk County in Book 1862 Page 1873.  Polk County received a quit claim from Camp Mack, Inc. on April 11, 1985, and was recorded in the Official Records of Polk County at Book 2324 Page 1766.  The cloud on the title is preventing Polk County from obtaining title insurance. 

Camp Mack, Inc. changed its name to CM 37, Inc. on June 3, 1998.  Subsequently, both corporations have subsequently been administratively dissolved.  Kissimmee River Volunteer Fire Station, Inc. was administratively dissolved on August 13, 1993.

To date, no other parties have claimed an interest in the real property located at 3801 Camp Lester Road.

 

RECOMMENDATION

Authorize the County Attorney’s Office to file a Quiet Title Complaint to quiet title on Polk County’s interest in 3801 Camp Lester Road, Lake Wales, FL 33853-9752.

Authorize the County Attorney or his designee to represent Polk County at any mediations or court proceedings held in the matter.

 

FISCAL IMPACT

Funding for the costs of litigating the Quiet Title Complaint will come from the County Attorney’s Fund.  The cost of litigation will be included as part of the Summary Judgement against the Defendants.
