DESCRIPTION

County staff recently responded to a property owner located near the intersection of Elizabeth Street and Junior Avenue in the Lakeland area regarding an existing drainage easement held by the county which was bisecting their property.  It was determined that due to a scriveners error the existing easement did not align with the drainage facilities.  In order to remedy the matter the property owner granted an easement to the county for the existing facilities and the county authorized a release of the easement containing the error to eliminate a bifurcation of the owners property, which were accepted and approved, respectively, by the Board late last year.  The replacement easement mentioned above covers the majority of the existing facilities; however, a small easement area has been identified, containing approximately 38 square feet, over the adjacent property needed to fully accommodate the operation and maintenance of the facilities.  The county contacted the owners, Maria Casanova and Juan Galan, and requested a drainage easement.  The owners agreed to the county’s request and have executed and delivered a Drainage Easement to the County.  Accepting the Drainage Easement will give the county the easement needed to accommodate the operation and future maintenance of the drainage facilities in this area.

RECOMMENDATION

Request Board accept the above-mentioned Drainage Easement.
