DESCRIPTION
The proposed resolution revises and clarifies de novo hearing procedures. The proposed resolution defines Organized Opposition as the entity or individual that files the application for de novo hearing and/or individuals that receives written authorization from at least five(5) entities or individuals to speak on their behalf against the application. The proposed resolution also establishes an alternative disclosure process pursuant to Section 286.0115(1), Florida Statutes, to remove the presumption of prejudice from ex parte communications from de novo hearings.
RECOMMENDATION
Adopt the proposed resolution revising de novo hearing procedures.
