DESCRIPTION

The County was the prior owner of a parcel of land identified as Parcel ID Number 252835-000000-041020, located between Spirit Lake Road and Shadow Wood Trial in the Winter Haven area, which was previously utilized for a small water production facility.  The conveyance of the property to the County in 1975 included a 20-foot wide ingress-egress easement from the site, along the northern boundary of the residential lot lying east of the subject site, to Spirit Lake Road due to the fact that the property did not have independent access to a public roadway.  The facility was recently decommissioned, and the property was sold through a private bid to an adjacent property owner earlier this year.  The adjacent property owner has access to the site from Shadow Wood Trail through their parcel therefore the ingress-egress easement mentioned above was excluded from the sale.  Since the county no longer owns the utility parcel the ingress-egress easement is not needed and is unnecessarily encumbering the adjacent property over which it lies.  Authorizing a Release of Easement will release the easement of record and will allow the adjacent property owner to fully utilize their property free of the encumbrance. 

 

RECOMMENDATION

Request Board authorize the afore-mentioned Release of Easement.
