DESCRIPTION
Richmond American Homes of Florida, LP is the developer of a residential subdivision known as Seasons at Heritage Square located along Johnson Avenue (CR 580) with the municipal limits of the City of Haines City. A plat was recently approved by the City and subsequently recorded in Plat Book 191, at Pages 49 through 52, Public Records of Polk County. The plat contained a parcel located along the northern boundary of the subdivision and adjacent to Johnson Avenue identified as Tract RES-1 which, according to notes stated on the plat, was reserved by the developer for future right-of-way to be dedicated by separate instrument. Representatives for the developer recently contacted the county and stated that at the time the right-of-way tract was established they mistakenly believed that Johnson Avenue was a state road and that FDOT would require the additional right-of-way in conjunction with the development. Once they realized that the roadway was a County road and that additional right-of-way was not needed to bring the right-of-way adjacent to the development up to current road classification standards the plat had already been filed. They requested the County accept the tract for additional right-of-way as they had no need for use for it and the subdivision had been designed based on the tract being utilized as right-of-way. The County reviewed the request and determined that the additional right-of-way may be utilized for current maintenance activities and/or for future improvements to the road corridor. The owner has executed and delivered a Quit Claim Deed to the County for the tract. Accepting the Quit Claim Deed will give the County additional right-of-way along Johnson Avenue adjacent to the development.
