DESCRIPTION

This is a County initiated ordinance amending the Land Development Code of Chapter 2, Table 2.1 to add “Cardboard & Shredded Paper Collection” as conditional uses in Business Park Center-1 (BPC-1), Business Park Center-2 (BPC-2) and Industrial (IND) districts; amending Section 206, Accessory Uses to add cardboard and shredded paper collection as accessory uses to non-residential development, amending Chapter 3, Section 303, Criteria for Conditional Uses to add Cardboard & Shredded Paper Collection with applicable conditions; amending Chapter 10, Definitions to define Cardboard & Shredded Paper Collection, Cardboard, and Shredded Paper, and modify Solid Waste Management Facility to exclude cardboard collection; providing for severability; providing an effective date. On July 6, 2022, the Planning Commission voted to recommend approval. The first reading was heard by the Board on July 19, 2022. However, the adoption hearing needs to be reset for November 1, 2022 to coincide with the adoption hearing of the related Comprehensive Plan amendment (LDCPAL-2022-4).

Section 163.3202, Florida Statutes (F.S.) requires the Board to adopt Land Development Code (LDC) regulations consistent with the implementation of the Polk County Comprehensive Plan.  Amendments to the LDC require two public hearings before the Board to be adopted.

RECOMMENDATION

Request Board reset the adoption hearing on November 1, 2022 at 9:30 a.m.
