Approve Polk County School Board's request for release of Educational System Impact Fees. (No fiscal impact)

DESCRIPTION
Under Polk County Impact Fee Ordinance 19-056, the Polk County School Board must submit a request to the Board of County Commissioners through the County Manager to request the release of Educational System Impact Fees collected on its behalf. Specifically, the School Board is requesting the release of $26,445,561 for the following:
(1) An additional $5,625,000 for the purchase of property for a new high school in the Poinciana area. On June 15, 2021, the Board released $6,375,000 for this same purpose. With the actual property now identified, the actual negotiated cost with the seller, to include infrastructure and mitigation improvements, is $12,000,000, thus the reason to request an additional $5,625,000; and,
(2) An additional $20,820,561 for the construction of Elementary School 21C. On June 15, 2021, the Board released $35,000,000 for this school, of which $26,485,000 was alotted for the actual building construction. On July 26, 2022, the School Board approved a construction contract with James B. Pirtle Construction Company, Inc. for $47,305,561.07 for the construction of Elementary School 21C, a $20,820,561 increase from the original allotment for the construction.
Pursuant to Section 6.04, Use of Educational System Impact Fees, the Office of Planning and Development has reviewed the request and finds it is a necessary growth-related capital project; it is an eligible expense under Section 6.04; and there are sufficient funds in the Educational System Impact Fee account at this time to fund the construction of the aforementioned improvements. The available balance of Educational System Impact Fees as of August 26, 2022, is $56,813,193.44.
