DESCRIPTION

The County has received a petition from Michael D. and Jean Braswell to vacate a portion of platted and unmaintained right-of-way shown as Park Road on the map of Park Place recorded in Plat Book 13, Page 25, Public Records of Polk County, Florida.  The subject right-of-way lies in Section 20, Township 27 South, Range 23 East.    

The map of Park Place, filed in 1925, dedicated to the public various rights-of-way throughout the plat.  The petitioners own parcels which are adjacent to the subject right-of-way and have requested to vacate the right-of-way to remove the bifurcation of their properties.  The petitioners contacted the adjacent property owners located to the south of the area to be vacated, James and Sharon Cramer, and they have consented to the vacation.  Vacating the subject right-of-way will remove the public’s interest in the area and allow the petitioners to assemble and more fully utilize their properties.

AT&T, Charter Communications, Zayo Group, Frontier Communications, City of Lakeland Electric and Teco Peoples Gas have no objections to the proposed vacation. 

The Roads and Drainage Division, Office of Planning and Development and the Utilities Division have no objections to the proposed vacation.

RECOMMENDATION

Request Board adopt a resolution to vacate a portion of platted, unmaintained right-of-way for Park Road as shown on the Plat Map of Park Place, as fully described in the legal description attached to the Petition and Resolution attached hereto.

There is no fiscal impact associated with this agenda item.
