SUBJECT
title
Approve Agreement for Transfer of Public Road between the City of Lake Alfred and Polk County for multiple unopened, unmaintained, platted rights-of-way and authorize a County Deed for said rights-of-way. (No fiscal impact)
body
DESCRIPTION
The plat of Phase “A” Westwood Section Meadowood Lakes Subdivision, recorded in Plat Book 58, at Pages 26 and 27, filed in December 1972 dedicated various rights-of-way to the public; however, neither the rights-of-way nor the lots have been improved since that time. Most of the platted lots, and all of the property surrounding the plat, are owned by the state and are part of the Hilochee Wildlife Management Area which lies within the municipal boundaries of the City of Lake Alfred (“City”). Since the rights-of-way are unassessed it is unclear whether or not they are located within the municipal limits and are proposed to be transferred to the City to allow for any future development actions by the City in conjunction with the state management area.
Florida Statutes allow for the transfer of public roads between jurisdictions by mutual agreement of the affected governments and a conveyance of the associated rights-of-way by deed. The City has reviewed and approved, at its meeting held May 20, 2024, an Agreement for Transfer of Public Road for the transfer of the subject rights-of-way and has agreed to accept a County Deed for the same. Approving said Agreement and authorizing a County Deed to the City will transfer jurisdictional control of the rights-of-way.
RECOMMENDATION
Request Board approve the aforementioned Agreement for Transfer of Public Road and authorize the County Deed to the City for the platted, unopened and unmaintained rights-of-way.
FISCAL IMPACT
No fiscal impact.
