title
Approve the Interlocal Agreement between Polk County (County) and the Tohopekaliga Water Authority (TOHO) for the purpose of amending water utility service areas.
body
DESCRIPTION
In 2006, the County and TOHO entered into the Poinciana System Transition Interlocal Agreement whereby the County authorized and transferred to TOHO all County rights, title, and interests to own and operate those portions of the Poinciana Utility System located within Polk County which was then owned and operated by the Florida Governmental Utility Authority. Certain undeveloped properties within unincorporated eastern Polk County are not currently identified within either the County’s East Regional Utility Service Area (ERUSA) or TOHO’s existing service area, and neither the County or TOHO have any existing facilities on or within the unserved areas The County and TOHO desire to amend their existing service areas and to define their respective service responsibilities for the unserved areas to facilitate the orderly provision of utility services within this area of eastern unincorporated Polk County. The County and TOHO agree that Lake Hatchineha Road generally serves as a logical physical dividing line for the delineation of retail utility service responsibility as depicted in the accompanying Interlocal Agreement Exhibits A through E.
