Accept Quit Claim Deed from JMBI Real Estate, LLC in conjunction with the Power Line Road improvements. (No fiscal impact)

DESCRIPTION
In March 2023 JMBI Real Estate LLC, along with others, entered into an Infrastructure and Impact Fee Credit Agreement with Polk County regarding an extension of Power Line Road from US Highway 17/92 to South Boulevard which included a requirement to convey right-of-way to the County. The majority of the right-of-way needed for the corridor has been conveyed to the County with the exception of a small segment located at the connection of Power Line Road and US Highway 17/92 for which a permit from FDOT is still needed along with a portion of platted and unmaintained right-of-way which was bisecting the corridor. The platted right-of-way was vacated in April of 2024 and the resulting assemblage is uncertain due to the adjacent segment of right-of-way which has not yet been conveyed to the County. A legal description for the vacated right-of-way associated with the roadway corridor was prepared and the owner of the adjacent property, JMBI Real Estate, LLC, has executed and delivered a Quit Claim Deed to convey any resulting interest in may have in it to the County. Accepting the aforementioned Quit Claim Deed will give the county ownership and/or clear title to the portion of vacated right-of-way needed for the Power Line Road corridor.
RECOMMENDATION
Request Board accept the above-mentioned Quit Claim Deed.
