DESCRIPTION
A recent survey conducted for the owners of a residential property located on Ohlinger Road, in the Babson Park area, revealed that a discrepancy exists in the monumented boundaries of the common boundary line between their property and the property to the west owned by Polk County. This discrepancy creates a long narrow hiatus parcel measuring approximately 14-feet wide at the northern end and approximately 2-feet wide at the southern end for which the ownership is unclear. The owners of the residential property, David M. Susla and Laurie C. Susla, his wife, through their legal counsel have requested the County convey any interest it may have in the hiatus parcel to them and a legal description was prepared for the subject area. An existing fence located along the eastern edge of the County parcel indicates that the historical occupation of the area is associated with the Susla property and the discrepancy is creating a cloud on their title. The County is not utilizing and has no need for the subject hiatus parcel. Authorizing a County Deed to Mr. and Mrs. Susla will release any interest the County may have in the hiatus parcel and will assist in clearing any clouds on the title caused by their occupation of the subject area.
RECOMMENDATION
Request Board authorize the aforementioned County Deed for the conveyance of the County’s interest, including any that may otherwise be reserved by Florida Statutes, to David M. Susla and Laurie C. Susla, his wife.
FISCAL IMPACT
No fiscal impact.
