DESCRIPTION
The County has received a petition from Suzanne Paulus Miller, Attorney, as authorized representative for Hope Rise Development, LLC and 234 Fantasy LLC, to vacate a portion of the 30-foot strip of land as shown on the plat of Holly Hill Addition to Loughman, as recorded in Plat Book 30, Page 38, and a portion of the 30-foot right-of-way of South Holly Hill Drive, as shown on the Plat of Roy A. Miller's Subdivision at Loughman, Fla. as recorded in Plat Book 32, Page 50, both recorded in the Public Records of Polk County, Florida. The subject rights-of-way lie in Section 12, Township 26 South, Range 27 East.
The plats of Holly Hill Addition to Loughman and Roy A. Miller's Subdivision, filed in 1936 and 1946, respectively, dedicated to the public various rights-of-way throughout the plats. The petitioners own all of the properties adjacent to the proposed vacation area and are currently developing the area. The Petitioners have requested the vacation to resolve certain conditions associated with the development. Multiple property owners, some of which are related to the Petitioners, utilize the subject right-of-way as part of their access and the Petitioners have granted easements to allow for continued access to their properties. Vacating the rights-of-way will remove the public's interest in the subject area which will allow the petitioner to continue with their planned development.
Frontier Communications, Spectrum, and Summit Broadband have no objections to the proposed vacation. Duke Energy and Florida Public Utilities, have requested utility easements, due to existing facilities in the subject rights-of-way, and the petitioner has complied with their request.
