DESCRIPTION
The owners of several large tracts of land located along the south side of Lake Hatchineha Road in the Town of Lake Hamilton are in the process of developing the property through the Town. During that process it was discovered that three recorded Right-of-Way Easements to Polk County are encumbering and bisected portions of the property. The property owners requested the County release the easements to accommodate their development plans. The stated purpose of the Right-of-Way Easements, granted in 1960, and recorded in O.R. Book 363, at Page 91, O.R. Book 363, at Page 92 and in O.R. Book 363, at Page 93, was for the construction, maintenance and operation of a road; however, the easements are not utilized by the County for this or any other purpose. Authorizing a Release of Easements will release the encumbrance of the easements from the properties and allow the owners to move forward with any development plans associated with the properties.
RECOMMENDATION
Request Board authorize the aforementioned Release of Easements.
