Approve Agreement for Transfer of Public Roads between the City of Davenport and Polk County for Huckleberry Road and Bargain Barn Road and authorize County Deeds for the rights-of-ways associated therewith. (No fiscal impact)

DESCRIPTION
Huckleberry Road is a County-maintained roadway running from Horseshoe Creek Road northward for approximately 645 feet to a dead-end. Bargain Barn Road is a public roadway between US Highway 17/92 and CR 547 with the County currently maintaining the portion from US Highway 17/92 to 42nd Street and the City of Davenport ("City") maintaining the portion from 42nd Street to CR 547. Both roads are classified as local residential roadways which lie within and/or adjacent to the municipal limits of the City. Huckleberry Road in its entirety and all of Bargain Barn Road which is maintained by the County are proposed to be transferred to the City in conjunction with proposed development adjacent to the roadways.
Florida Statutes allow for the transfer of public roads between jurisdictions by mutual agreement of the affected governments and a conveyance of the associated rights-of-ways by deed. The City has reviewed and approved, at its meeting held February 03, 2025, Agreements for Transfer of Public Roads for the transfer of the roadway and has agreed to accept the County Deeds for the associated rights-of-ways. Approving said Agreements and authorizing the County Deeds to the City for the associated rights-of-ways will transfer ownership of the subject roadways and will remove them from the County's Road inventory thereby allowing the County to cease maintenance and future liability responsibilities associated with them.
RECOMMENDATION
Request Board approve the aforementioned Agreements for Transfer of Public Roads and authorize the County Deeds to the City for the rights-of-ways associated therewith.
