SUBJECT

title

Approve Interlocal with the School Board of Polk County to provide for location and support staff for the local hearing officer to hear violations of Section 316.172(1)(a)&(b), Fla. Stat. (“Stop Arm Law”).

body

DESCRIPTION

The School Board of Polk County has installed and operates infraction detection systems on school buses for the purpose of enforcing Section 316.172(1)(a)&(b), Fla. Stat. (“Stop Arm Law”) and  a local hearing officer (“LHO”) must be appointed to hold administrative hearings to allow individuals to contest liability or the notice violations that are issued for violations of the Stop Arm Law.  The School Board has requested the County’s assistance in providing the location and the support staff for the hearings for the LHO appointed by the School Board. The proposed interlocal provides for the assignment of an LHO Assistant and an LHO Clerk on the day of hearings and for their time to be invoiced to the School Board on a quarterly basis at $72.39 per hour for the LHO Assistant and $37.49 per hour for the LHO Clerk.  Under the proposed interlocal, the County would provide the location for the hearings.
