Approve maintained right-of-way maps for Firetower Road, Lundy Road, Seminole Road, Ann King Road, and Rogers Road. (No fiscal impact)

DESCRIPTION
Many of the roads in the State of Florida and within Polk County were constructed years ago with narrow or non-existent rights-of-way. To correct this situation, Florida Statutes allow the State, County, or Municipality to file a map as prima facie evidence of ownership of the road with the Clerk of Circuit Court in the County in which the road lies. The State, County, or Municipality is required to certify that it has maintained the roads continuously for a minimum of seven years.
Maintained right-of-way maps have been prepared for the following roads lying within Polk County:
1. Firetower Road from a point where deeded right-of-way terminates thence westerly for approximately 160 feet to a point near an existing gate. The right-of-way is located in Section 10, Township 29 East, Range 28 East.
2. Lundy Road from its intersection with County Road westerly for approximately 1,600 feet to its dead end. The right-of-way is located in Sections 10 and 15, Township 27 South, Range 25 East.
3. Seminole Road from its intersection with Ann King Road westward approximately 2.1 miles to its dead end. The right-of-way is located in Sections 31, 32, and 33, Township 30 South, Range 28 East and Sections 4, 5, and 6, Township 31 South, Range 28 East.
4. Ann King Road from its intersection with Cody Villa Road northwar approximately 5,000 feet to its intersection with Seminole Road. The right-of-way is located in Section 4, Township 31 South, Range 28 East.
5. Rogers Road from its intersection with Hollister Road northward approximately 2,500 feet to its intersection with Seminole Road. The right-of-way is located in Section 5, Township 31 South, Range 28 East.
The maintenance units in which these roadways lie have maintained the roadways for more than seven years and will certify the maps. Approving the recording of the maintained right-of-way maps will fulfill the requirements of the Florida Statutes and give public notice of the County’s ownership of the rights-of-way.
RECOMMENDATION
Request Board approve the aforementioned maintained right-of-way maps.
