Approve Interlocal Agreement for Transfer of Roads and Maintenance between City Center Community Development District and Polk County for the transfer of Grandview Parkway and Posner Boulevard and associated drainage facilities. (Up to $500,000 one-time revenue)

DESCRIPTION
Grandview Parkway is a four-lane divided roadway running along the rear of the Posner development located at US Highway 27 and Interstate 4. The roadway runs from Ernie Caldwell Boulevard northward and currently terminates just to the south of the interstate. For many years County has planned a flyover overpass over the interstate to connect Grandview Parkway to Dunson Road to provide traffic relief with an alternative to the highly congested US Highway 27 corridor. More recently the County has come to an agreement with the Florida Department of Transportation (“FDOT”) to partially fund the improvements, which is included in the County’s 5-year CIP, with FDOT handling the design and construction in conjunction with its Moving I-4 Forward Project. In order to move forward with the planned flyover FDOT is requiring that the County take ownership and maintenance responsibilities of Grandview Parkway which is currently owned by the City Center Community Development District (“CDD”).
Ongoing and extensive discussions with the CDD have resulted in an agreement wherein the CDD would transfer ownership of Grandview Parkway as well as Posner Boulevard due to its interconnectivity with the existing public roadway infrastructure in the area. As part of the Agreement the CDD and the County would enter into a joint use drainage easement for the storm water facilities which are associated with runoff from both the roadways and adjacent development. The County would be responsible for the future maintenance of the roadways and the CDD would be responsible for future maintenance and repair of the landscaping, irrigation, street lighting and sidewalks within the rights-of-way of the roadways. The roadways require various repairs which will be made by the County shortly after the transfer and the CDD has agreed to reimburse the County up to $500,000 for the estimated cost of the repairs. The Interlocal Agreement was approved by the CDD Board at its meeting held March 10, 2026. Approving the Interlocal Agreement for Transfer of Roads and Maintenance will allow the County to take ownership of the roadways and allow the FDOT to move forward with the planned flyover.
RECOMMENDATION
Request Board approve the aforementioned Interlocal Agreement for Transfer of Roads and Maintenance and accept and approve the real estate related documents referenced therein and attached thereto.
FISCAL IMPACT
Funds for the reimbursement of repair costs will be deposited into the appropriate fund, as determined by Finance and Accounting.
