Approve Memorandum of Agreement between the State of Florida, Department of Transportation and Polk County regarding the Central Polk Parkway and authorize a County Deed for right-of-way parcels associated therewith. (No fiscal impact)

DESCRIPTION

The State of Florida, Department of Transportation through its Florida’s Turnpike Enterprise (“FTE”) has a project to construct a segment of a new limited access toll road facility known as the Central Polk Parkway (SR 570B) from US Highway 17 to State Road 60.  The Central Polk Parkway was previously adopted by the County’s Transportation Planning Organization into its Long-Range Transportation Plan as a priority project for the County as it is expected to alleviate traffic on County roadways in the region.  Design for the project is nearly completed and FTE is anticipating letting the project early next year with the construction starting in early 2025. 

FTE’s project will include the construction of a 12-foot-wide shared use path, within a generally 50-foot wide right-of-way, along the westerly side of the road corridor which will be conveyed to the County at the completion of the project.  Additionally, the project will impact several properties owned and by the County along the project corridor and staff for both parties have been in discussions for over a year regarding the path and property impacts.  Four right-of-way parcels, containing a total of approximately 3,400 square feet, are needed by FTE from property owned by the County.  Parcel 108C is a very small, vacant, triangular shaped parcel containing approximately 630 square feet along the eastern side of US Highway 17 which escheated to the County in 1992.  Parcels 108A and 108E are associated with right-of-way acquired by the County through a maintained right-of-way map for 1st Street recorded in Map Book 7 at Page 129.  Lastly, Parcel 108F is a small portion of right-of-way, primarily adjacent to State Road 60, that was previously acquired by the County for the Bartow Northern Connector Phase 2 project which is not planned for construction.     

A Memorandum of Agreement has been prepared which memorializes the above-mentioned items as well as other items such as air rights for the proposed bridge crossing over a county road.  The County Attorney’s office and the Real Estate Services Director have reviewed the agreement and recommend approval.  Approving the Agreement and authorizing the County Deed associated therewith will give FTE the right-of-way needed to move forward with letting and construction of the project.

RECOMMENDATION

Request Board approve the aforementioned Memorandum of Agreement and authorize the County Deed associated therewith and referenced therein.  Also authorize the Real Estate Services Director to sign the closing documents associated with the conveyance of the right-of-way parcels.
