DESCRIPTION

The County has received a petition from Heather M. Urwiller, as authorized agent for Lisa Sherrouse, to vacate and close right-of-way for J Day Drive, an existing county-maintained roadway. The subject right-of-way lies in Section 13, Township 29 South, Range 24 East.

The right-of-way for J Day Drive, which is a County maintained roadway, was conveyed to Polk County in 1956 by Quit Claim Deed which was recorded in Deed Book 1041, Pages 296 and 297.  J Day Drive is a paved dead-end roadway located west of US Highway 98 and to the north of County Road 540A.  It is approximately 550-feet long and 25-feet wide and currently only serves two adjacent properties owned by the petitioner which are partially bisected by the road right-of-way. The petitioner is requesting the vacation to remove the bifurcation and prepare the properties for future development. After a review by County staff, it was determined that vacating the subject area would not negatively impact local traffic.  Vacating the subject right-of-way will remove the public’s interest, allow the County to cease maintenance activities associated with the existing roadway, and allow the petitioner to assemble with her properties.

Charter Communications, the City of Bartow Water and Sewer Divisions, the City of Lakeland Water and Wastewater Divisions, Florida Public Utilities, Frontier Communications, and the Zayo Group have no objections to the vacation request. Lakeland Electric and Polk County Regional Cooperative (PRWC) requested utility easements for their facilities and the petitioner has complied with their requests.

The Roads and Drainage Division, Office of Planning and Development, and Utilities Division have no objections to the proposed vacation.

RECOMMENDATION

Request Board adopt a resolution to vacate the deeded and maintained right-of-way for J Day Drive, as fully described in the legal description contained in the Petition and Resolution attached hereto.

No fiscal impact.
