DESCRIPTION

The County has received a petition from Jeromy Andrew to vacate a portion of platted, unopened, and unmaintained right-of-way (alley) lying south of Lots 1 through 11, Block 8, as shown on map of the Town of Medulla, as recorded in Plat Book 2, at Page 37 which is a correction of the map entitled Henry Hays Map of Medulla, recorded in Plat Book 2, Page 19, both of the Public Records of Polk County, Florida.  The subject right-of-way lies in Section 13, Township 29 South, Range 23 East.

The map of Henry Hays Map of Medulla and the corrected map entitled Town of Medulla filed in 1908 and 1910, respectively, depict various rights-of-way throughout the plat. The petitioner has requested the vacation of the right-of-way (alley) lying to the south of his property in order to assemble with, and maintain as part of, his property. During a review of the area, it was discovered that vacating the requested area would leave an isolated segment of platted right-of-way to the east of Block 8, and adjacent to the railroad right-of-way, so the County is adding it to the vacation request. County staff contacted the adjacent property owners and received one objection from Enid Figueroa the owner of a vacant parcel located to the east of the petitioner; however, her primary access is from Watson Drive which will not be affected by the vacation. Vacating the subject rights-of-way will remove the public’s interest in the subject areas and allow the petitioner, and adjacent property owners within the plat to utilize their respective properties more fully due to the assemblage. 

 

Frontier Communications, City of Lakeland Electric, and City of Lakeland Water/Wastewater have no objections to the proposed vacation.

 

The Roads and Drainage Division, Office of Planning and Development, and Utilities Division have no objections to the proposed vacation. 

 

RECOMMENDATION

Request Board adopt a resolution to vacate portions of platted, unopened, and unmaintained rights-of-way shown on map of the Town of Medulla which is a correction to the map entitled Henry Hays Map of Medulla, as more fully described in the legal description contained in the Petition and Resolution attached hereto.

FISCAL IMPACT

There is no fiscal impact associated with this agenda item.
