DESCRIPTION

In 2017, the Florida Legislature passed HB 573, the Heartland Headwaters Protection and Sustainability Act, which acknowledges the critical importance of Polk County’s aquifers to the economic and ecological health of the surrounding regions.  The FDEP awards these state funds to the PRWC pursuant to grant Agreement Number LPA0212 (Grant Agreement). The funds are either awarded directly to the PRWC to fund the regional project or as a pass-through to the participating members for projects identified in the grant documents.  The Polk County Alternative Water Supply Receiving Facility Project for the Northeast Regional Utility Service Area is included in the grant documents and is eligible to receive pass-through state funds.

On September 21, 2022, Polk County and the PRWC entered into an agreement to allow Polk County to receive funds from the Heartland Headwater Protection and Sustainability Act. 

On September 3, 2024, the Board of County Commissioners approved Amendment 1 to incorporate the changes to the Grant Agreement between FDEP and the PRWC. 

On March 19, 2025, the Board of County Commissioners approved Amendment 2 to incorporate the changes to the Grant Agreement between FDEP and the PRWC. 

Amendment 3 to the Agreement between the PRWC and Polk County incorporates and implements the changes to the Grant Agreement between FDEP and the PRWC, which includes pass-through funding in the amount of $416,098 for the Polk County Alternative Water Supply Receiving Facility Project for the Northeast Regional Utility Service Area. Subject to requirements set forth in the Grant Agreement, Polk County will request reimbursement for all eligible expenses from the PRWC. 

RECOMMENDATION

Request Board approve the Third Amendment to the Agreement between the PRWC and Polk County for the PRWC Heartland Protection and Sustainability Project, Polk County Alternative Water Supply Receiving Facilities (Project 6), for which the Florida Department of Environmental Protection (FDEP) awarded state funds via grant Agreement Number LPA0212 in the amount of $416,098 reimbursable expenses.

 

FISCAL IMPACT

Funding in the amount of $416,098 is available in the Utilities Community Investment Program in the Northeast Regional Utility Service Area PRWC AWS Receiving Facility project budget.
