Approve a Right-of-Way Agreement between Polk County and Kytran Nugyen and Ngoc Diem Nguyen in conjunction with the Thompson Nursery Road Phase 1 - Segment 4 Improvement project. ($455,000 one-time expense)

DESCRIPTION
The County has a project to improve and realign Thompson Nursery Road from West Lake Ruby Drive to U.S. Highway 17 consisting of primarily a new alignment for a four-lane corridor. The project was separated into four segments of the corridor due to the nature, and associated challenges, of certain portions of the alignment. The segment known as Segment 4 consists of primarily widening, from two-lanes to four-lanes, the existing Eloise Loop Road from just to the east of its intersection with West Lake Ruby Road to a point approximately 1-mile to the west of said intersection and includes some realignment near the western end. The engineering for this segment is very nearly complete and full acquisition is expected to begin later this year. The Board previous adopted a resolution authorizing negotiations and written offers to be made on this project.
Parcel 173 has been identified as a whole take fee parcel needed for the realignment portion as well as for a storm water retention pond. The parcel is a platted residential lot containing approximately 2/3 of an acre located along the north side of Eloise Loop Road which is improved with a single-family residence. The County contacted the owners of the parcel, Kytran and Ngoc Diem Nguyen, and they expressed an interest moving forward with the acquisition process. The County hired an independent appraiser to establish a value for the parcel and subsequent negotiations with the owners have resulted in a proposed settlement amount of $450,000 for the purchase of the parcel. The owners have not incurred any attorney fees or expert costs in conjunction with this acquisition. The County Attorney’s Office and the Real Estate Services Director have reviewed the agreement and recommend approval. The alternative of acquiring this parcel through condemnation litigation would result in substantial cost to the County. Approving the Right-of-Way Agreement, authorizing the issuance of funds for the purchase and closing costs and hiring American Government Services Corporation to close the acquisition will allow the County to close the transaction and take ownership of the parcel for the project.
RECOMMENDATION
Request Board approve the aforementioned Right-of-Way Agreement and authorize the issuance of funds in the amount of $450,000 for the purchase of the property. Also request Board approved hiring American Government Services Corporation to close the acquisition of the property and approve paying estimated closing costs in the estimated amount of $5,000 for a total of $455,000.
FISCAL IMPACT
Funds are available for the purchase of the parcel along with closing costs in the Impact Fee Zone A Fund.
