DESCRIPTION

The County has a project to construct a receiving station along the south side of Masterpiece Road at its intersection with Timberlane Road for alternative water being supplied by the Polk Regional Water Cooperative as part of its southeast transmission system.  The receiving station is proposed to be connected to an existing water treatment facility known as the Timber Lake treatment facility located approximately 1-mile to the north of the receiving station at the northeast corner of Timber Lane Road and Pierce Drive.  In order to connect the receiving station with the treatment facility a new water main is proposed generally along Timber Lane Road; however, limited right-of-way and existing conflicts on the southern portion of Timber Lane Road preclude the construction of the pipeline without acquiring multiple utility easements.  A proposed easement was identified, measuring 15-feet wide, along the eastern boundary of a large tract of land owned by Texas Aquatic Harvesting, Inc. which would accommodate the construction, operation and future maintenance of a portion of the proposed pipeline from Masterpiece Road to Stumpknocker Road which would circumvent the constrained areas of Timber Lane Road.  The County contacted the owner of the property regarding who was agreeable to selling an easement.  Negotiations with the owner have resulted in a proposed purchase price of $75,000 and it has executed an Agreement.    

The County Attorney’s Office and the Real Estate Services Director have reviewed the proposed agreement and recommend approval.  Approving the Agreement and authorizing the issuance of funds for the purchase will give the County the easement needed for the construction, operation and maintenance of the proposed water pipeline.

RECOMMENDATION

Recommend Board approve the Agreement and authorize the issuance of funds in the amount of $75,000 for the purchase.

FISCAL IMPACT

Funds are available for the purchase and associated closing costs in the Utilities Fund ERUSA AWS Receiving Facility.
