DESCRIPTION

The County has received a petition from Abdul Alkadry, P.E., as authorized agent for GLK Real Estate, LLC, to vacate certain portions of platted, unopened, and unmaintained rights-of-way lying within the map of Florida Development Co. Tract recorded in Plat Book 3, Pages 60 through 63 and Replat of Lakewood Heights recorded in Plat Book 26, Page 15, Public Records of Polk County, Florida.  The subject rights-of-way lie in Section 14, Township 27 South, Range 27 East.

 

The map of Florida Development Co. Tract, filed in 1914, depicts, and the Replat of Lakewood Height filed in 1927 dedicates to the public, various rights-of-way throughout the plats. The petitioner owns multiple large parcels lying adjacent to the subject rights-of-way and has requested the vacation for a planned residential development known as Crosswinds East which is located within the municipal limits of Haines City.  Most of the platted rights-of-way were not annexed within the city limits, so the petitioner is requesting that certain platted rights-of-way be vacated to accommodate the development.  County staff contacted the three owners of the properties adjacent to the subject right-of-way which are not owned by the Petitioner and received no responses from two of the property owners.  The third property owner, Mr. Charles Stewart, contacted the County with concerns regarding what portion of the vacated rights-of-way would be assembled with his property.  There is a small portion that abuts the southwest corner of his property that is between the two plats that he has concerns about.  He feels he should get all of the platted right-of-way; however, the Property Appraiser will split the right-of-way between the two plats in accordance with statute.  Vacating the rights-of-way will remove the public’s interest in the subject areas and allow the petitioner and adjacent property owners, to more fully utilize their properties.

 

The City of Haines City Utilities, City of Davenport Utilities, Duke Energy, Charter Communications, and Frontier Communications have no objections to the proposed vacation.

 

The Roads and Drainage Division, Office of Planning and Development, and Utilities Division have no objections to the proposed vacation.

 

RECOMMENDATION

Request Board adopt a resolution to vacate platted, unopened, and unmaintained rights-of-way as shown on the map of Florida Development Co. Tract and the Replat of Lakewood Heights, as more fully described in the legal descriptions contained in the petition and Resolution attached hereto.

 

FISCAL IMPACT

No fiscal impact.
