DESCRIPTION

A recent survey conducted for the developer of large tracts of land located adjacent to White Road in Lake Alfred identified a 25-foot wide strip of property which was excluded from deeds in the chain of title and essentially bisecting the property of the current owner.  The developer stated that the strip is owned by the County; however, it is not reflected on the Property Appraiser maps and the survey did not identify the basis of the County’s ownership.  Research revealed that the County acquired one of the tracts of land in 1951, due to non-payment of taxes, by a Final Decree recorded in Chancery Order Book 181, at Pages 105 through 113.  In 1955 the County sold the tract which was conveyed by a County Deed recorded in Deed Book 1013, at Page 54; however, the description on the County Deed lessed out the north 25-feet of the tract for a road.  It is unclear what the reason for the less out statement was but no county roadway has been located within this location for at least the past 30 years and the County has no need or use for the strip of property.  The developer requested the County convey any interest it has in the strip of property to the current property owner to clear title to the property in preparation for the planned development.  Authorizing a County Deed to the current owner of the adjacent properties, Tree-O Groves, Inc., will release and convey any interest the County may have in the strip to remove the bifurcation of, and clear title to, the adjacent property for the proposed development.

RECOMMENDATION

Request Board authorize the aforementioned County Deed for the conveyance of the County’s interest, including any that may otherwise be reserved by Florida Statutes, in the subject strip of land to Tree-O Groves, Inc
