DESCRIPTION
The County acquired a fee interest in Parcel ID Number 262834-658500-000561 through the escheatment process by a Tax Deed dated May 31, 1991, which was subsequently recorded in Official Records Book 5027 at Page 1918. The parcel is a rectangular shaped parcel, measuring approximately 15-feet wide and containing approximately 2,178 square feet, lying east of Citrus Drive in the Winter Haven area.
The owners of the two properties along the north side of the subject property utilize, and rely on, the parcel as shared access to their properties from Citrus Drive. The County was contacted on behalf of one of the adjacent property owners regarding the condition of the concrete access drive located within the parcel. After a review of the parcel it was determined that it is not associated with the County road system and it would be in the best interest of all parties that the property be conveyed to the owners of the two adjacent properties to provide them with legal access to their properties from the County maintained Citrus Drive. County staff contacted the owners to discuss the property and agreed to remove and replace the concrete access driveway and convey the parcel to them once completed. The owners, Paul Pero and Mihalis and Georgia Houvardas, husband and wife, agreed to the County’s request and to accept a conveyance of one-half interest each in the subject property. The reconstruction of the concrete access drive has been completed by the County’s contractor.
Florida Statutes allow for the disposal of County-owned real property by declaring the property surplus and authorizing its private conveyance. Declaring the above-described parcel surplus and authorizing its conveyance will allow the adjacent property owners to take ownership of their respective interests of the property thereby providing them with legal access to their properties, place it back on the tax roll, remove the property from the County Land Inventory and allow the County to cease any maintenance activities associated with that portion of property. The subject parcel is being transferred in “as is” condition and the conveyance of the property will be by County Deeds.
RECOMMENDATION
Request Board declare the above mentioned County-owned parcel surplus and authorize the private conveyances of the County’s interest, including any that may otherwise be reserved by Florida Statutes, to Mihalis and Georgia, husband and wife, as to a one-half interest and to Paul K. Peros, as to a one-half interest.
FISCAL IMPACT
No fiscal impact.
