Accept an Access Easement from Ritchie Bros. Properties Inc., in conjunction with a Polk County Utilities existing Lift Station. (No fiscal impact)

DESCRIPTION
Polk County Utilities owns and operates a wastewater lift station known as Lift Station 75 near the interchange of I-4 and US Highway 27 in the northeast portion of the County. The lift station is situated on a small parcel of land owned by the county located to the rear of multiple commercial properties which front US Highway 27. There are existing easements in favor of the county between the site and the highway for the utility lines associated with the lift station; however, these easements are narrow and are not well situated to accommodate vacuum trucks and other vehicles, or equipment, needed to service or repair the lift station. The county contacted the owner of the large tract of land to the east of the lift station site, Ritchie Bros. Properties, Inc., to request access to the site through its property. The adjacent property is utilized by the owner for a large-scale equipment auction operation and the internal surface roads are located very near the lift station site. Ongoing discussions with the owner have resulted in a proposal wherein the county would construct a driveway from the existing internal roadway across a narrow area of property associated with the owner’s storm water management area to accommodate access to the lift station. The owner has agreed to allow for the construction of the proposed driveway for ingress/egress over the driveway area as well as the existing internal roadways and has executed and delivered an Access Easement to the County. Accepting the Access Easement will allow the County to move forward with the construction of the driveway to provide suitable access for the operation, maintenance, repair and future replacement of the existing lift station.
RECOMMENDATION
Request Board accept afore-mentioned Access Easement.
