DESCRIPTION
On March 8, 2011, the Board of County Commissioners approved the Interlocal Agreement relating to the establishment of the Water Cooperative of Central Florida (the Cooperative) by and among the City of St. Cloud, Florida, Tohopekaliga Water Authority (TOHO), and Polk County, Florida. On August 30, 2011, the Cooperative entered into the Cypress Lake Alternative Water Supply Agreement (Agreement) with Orange County and the Reedy Creek Improvement District (RCID) relating to the preliminary design and permitting of the Project. After entering into the Agreement, Orange County became a member of the Cooperative. The RCID subsequently withdrew from the Agreement on February 28, 2023.
Amendments one through six to the Agreement defined each party’s financial and administrative roles and obligations related to design, permitting and construction of the Project. The Seventh Amendment to the Agreement will authorize additional work as follows: 1) construction of two (2) additional production wells (CL-5 and CL-6); 2) construction of the raw water main to connect CL-5 and CL-6 to the water treatment plant site; 3) acquisition of property for CL-5 and CL-6 and easements for the raw water main routing; 4) completion of an update to the hydraulic model and infrastructure cost estimate found in the Water Wheeling Plan; 5) engagement of consultant services for construction administration and construction observation for CL-5 and CL-6; 6) engagement of consultant services for construction administration for construction of the raw water main to connect CL-5 and CL-6 to the water treatment plant site; 7) engagement of consultant services for preparation of funding applications and reports (WIFIA, Bonds, etc.); and 8) provision of a contingency for unforeseen and additional services related to the Project.
The Seventh Amendment will increase the authorized expenditures under the Interlocal Agreement by $18,400,000 of which Polk County’s share will be 10% or $1,840,000. A breakdown of the Phase III, Stage 8 costs associated with the Seventh Amendment is included in Exhibit 9. Following approval of the Seventh Amendment by the member government governing boards, the amendment will be considered by the Cooperative Board of Supervisors. The amendment does not become effective unless and until all parties have approved and executed the amendment.
RECOMMENDATION
Request Board approve the Seventh Amendment to the Cypress Lake Alternative Water Supply Agreement with the Water Cooperative of Central Florida at a cost to the County not to exceed $1,840,000.
FISCAL IMPACT
Funding is currently included in the 5-year CIP budget for the Cypress Lake project.
