DESCRIPTION

The County acquired a fee interest in Parcel ID Number 283012-944600-070503 through a Final Judgement dated March 15, 1968, which was subsequently recorded in Official Records Book 1145 at Page 121. The parcel is a small vacant triangular shaped parcel, containing approximately 250 square feet, located along the southerly side of Eucalyptus Road to the east of Lake Wales. Due to the size, shape and location of the property it is not buildable and is only of use and benefit to the adjacent property owners.  The County was contacted by the property owners adjacent to the east, Shauna and Mark Miratsky, who expressed an interest in purchasing the property.  The property was reviewed by the appropriate County Divisions and it was determined that there is no County need or use for the property. The County subsequently contacted the other two adjacent property owners, neither of which expressed an interest in purchasing the property.  The County requested, and the Miratsky’s have agreed to pay, the amount of $500 for the conveyance of the County’s interest in the parcel.

 

Florida Statutes allow for the disposal of County-owned real property by declaring the property surplus and authorizing its private conveyance. Declaring the parcel surplus and authorizing its sale will allow the adjacent property owners to purchase the property, place it back on the tax roll and remove the property from the County Land Inventory.

 

RECOMMENDATION

Request Board declare the above-mentioned County-owned parcel surplus and authorize the private conveyance of the County’s interest, including any interest that may otherwise be reserved by Florida Statutes, to Shauna Miratsky and Mark Miratsky, for the amount of $500 with the condition that the recording fees and documentary stamps shall be borne by the prospective buyer.  Ownership of the property will be transferred in “as is” condition and conveyance will be by County Deed.

 

FISCAL IMPACT

Proceeds from the sale of the parcel to be deposited into the appropriate fund, to be determined by Finance and Accounting.
