DESCRIPTION

The County has received the following requests to adopt resolutions vacating, abandoning, discontinuing, closing, renouncing, and disclaiming any rights of the County or the public in certain platted rights-of-way. Florida Statutes, Section 336.10, requires the Commissioners hold a public hearing to consider Petitions adopting resolutions vacating, abandoning, discontinuing, closing, renouncing, and disclaiming property under their control. Setting a public hearing date will comply with Florida Statutes and allow the request to be considered.

Request Board set a public hearing date for the following requests to vacate platted rights-of-way. Suggested Hearing Date: Tuesday, September 17, 2024 at 9:00 a.m., or immediately following the regular agenda:

1.                     Consider a petition by Suzanne Paulus Miller, attorney, as authorized representative for Hope Rise Development, LLC and 234 Fantasy LLC, to vacate portions of platted and unmaintained rights-of-way as shown on the plat of Holly Hill Addition to Loughman, recorded in Plat Book 30, at Page 38 and on the plat of Roy A. Miller’s Subdivision at Loughman, recorded in Plat Book 32, at Page 50, both of the Public Records of Polk County, Florida.  The subject rights-of-way lies in Section 12, Township 26 South, Range 27 East. 

2.                     Consider a petition by Bryan Mixon, as President of Ridge Youth Agriculture Foundation, Inc., et al, to adopt a resolution vacating portions portion of as shown on the plat of Waverly Manor Town Unit No. 1, recorded in Plat Book 25, at Page 5 and on the plat of Washington Park, recorded in Plat Book 31, at Page 38, both of the Public Records of Polk County, Florida.  The subject rights-of-way lie in Section 4, Township 29 South, Range 27 East.

3.                     Consider a petition by James Emory to adopt a resolution vacating a portion of platted, unopened and unmaintained right-of-way shown as Third Street lying adjacent to Lot 11, Block “A”, as shown on the map of Crosby’s Addition to Loughman, as recorded in Plat Book 4, at Page 43, Public Records of Polk County, Florida.  The subject right-of-way lies in Section 12, Township 26 South, Range 27 East.

 

RECOMMENDATION

Request Board set a Public Hearing on Tuesday, September 17, 2024 at 9:00 a.m., or immediately following the regular agenda, to consider the preceding items.
