Approve maintained right-of-way maps for Garfield Road, Lake Hendry Road, Southern Avenue, Spruce Road and West Lake Hamilton Drive. (No fiscal impact)

DESCRIPTION
Many of the roads in the State of Florida and within Polk County were constructed years ago with narrow or non-existent rights-of-way. To correct this situation, Florida Statutes allow the State, County, or Municipality to file a map as prima facie evidence of ownership of the road with the Clerk of Circuit Court in the County in which the road lies. The State, County, or Municipality is required to certify that it has maintained the roads continuously for a minimum of seven years.
Maintained right-of-way maps have been prepared for the following roads lying within Polk County:
1. Garfield Road from its intersection with Lake Hendry Road westerly then northerly for approximately 1.5 miles to its intersection with Lake Hendry Road. The right-of-way is located in Sections 6 and 7, Township 31 South, Range 26 East.
2. Lake Hendry Road from a point approximately 400 feet east of its intersection with 80 Foot Road easterly for approximately 3,700 feet. The right-of-way is located in Section 31, Township 30 South, Range 26 East and Section 6, Township 31 South, Range 26 East.
3. Southern Avenue from its intersection with Faye Street northerly for approximately 1,400 feet to its intersection with Ariana Street. The right-of-way is located in Section 26, Township 28 South, Range 23 East.
4. Spruce Road from its intersection with Bomber Road northerly for approximately 1 mile to its intersection with US Highway 17. The right-of-way is located in Sections 12 and 13, Township 29 South, Range 25 East.
5. West Lake Hamilton Drive approximately 3,700 feet northerly to its intersection with Lucerne Park Road. The right-of-way is located in Section 1, Township 28 South, Range 26 East and Section 6, Township 28 South, Range 27 East.
The maintenance units in which these roadways lie have maintained the roadways for more than seven years and will certify the maps. Approving the recording of the maintained right-of-way maps will fulfill the requirements of the Florida Statutes and give public notice of the County’s ownership of the rights-of-way.
RECOMMENDATION
Request Board approve the aforementioned maintained right-of-way maps.
