DESCRIPTION

The County acquired a fee interest in Parcel ID Number 263116-000000-012100 by Quit Claim Deed dated December 20, 1993, which was subsequently recorded in Official Records Book 3336 at Page 2127. The parcel is a rectangular-shaped parcel, containing approximately 1.40 acres, located to the north of J. Jackson Road in the Fort Meade area.  The property was donated to the County; however, it is unclear for what purpose the property was accepted.  The owners of the properties adjacent to the west and north of the parcel, SR Growers LLC, a Florida limited liability company and its sister company Southerland Ranch LLC, a Florida limited liability company, recently contacted the County and expressed an interest in purchasing the property. The property was reviewed by the appropriate County divisions, and it was determined that there is not a County need or use for the property. Additionally, the parcel does not appear to have independent or developable/buildable access and as such it is only of use and benefit to the owners of the adjacent properties. The County contacted the owners of the remaining two adjacent properties via certified mail and received no responses. The County requested the amount of $3,500 for the purchase of the parcel based on an in-house valuation utilizing available data and the owner has agreed to pay for the conveyance of the County’s interest in the parcel.

Florida Statutes allow for the disposal of County-owned real property by declaring the property surplus and authorizing its private conveyance. Declaring the parcel surplus and authorizing its sale will allow the owner of the adjacent property to purchase the subject property, place it back on the tax roll, remove the property from the County Land Inventory and allow the County to cease any maintenance activities associated with that portion of property. The subject parcel is being transferred in “as is” condition and the conveyance of the property will be by County Deed.

RECOMMENDATION

Request Board declare the above-mentioned County-owned parcel surplus and authorize the private conveyance of the County’s interest, including any interest that may otherwise be reserved by Florida Statutes, to SR Growers LLC, a Florida limited liability company, for the amount of $3,500, with the condition that the recording fees and documentary stamp taxes shall be borne by the buyer.

FISCAL IMPACT

Proceeds from the sale of the parcel to be deposited into the appropriate fund, to be determined by Finance and Accounting.
