DESCRIPTION

The County has received a petition from Jeffrey M. Satfield, P.E., as authorized agent for Circus Inn, Inc. to vacate a portion of maintained right-of-way for Holly Hill Grove Road 1 as shown on the Maintained Right-of-Way Map recorded in Map Book 23, at Pages 21 through 25 and shown as St. Claire Terrace on the plat of Holly Hill Grove & Fruit Co. as recorded in Plat Book 17, Page 40, all of the Public Records of Polk County, Florida.  The subject right-of-way lies in Section 30, Township 26 South, Range 27 East.

The Plat of Holly Hill Grove & Fruit Co. filed in 1925 dedicated various rights-of-way throughout the plat to the public. Additionally, a maintained right-of-way map was filed in 2015 for Holly Hill Grove Road 1 which runs from US Highway 27 to FDC Grove Road. The petitioner currently owns large tracts of land to the north and south of the eastern section of the roadway which is under contract with a large-scale developer.  The petitioner has requested the vacation to remove the bifurcation of the roadway and allow the development, as planned, to move forward.  The plans for the development call for the construction of a cul-de-sac at, or near, the western boundary of the subject vacation area and development site.  The County has requested an easement from the petitioner to allow the portion of roadway being vacated to remain open and operational until such time as the Grantor, or its successors and assigns, construct the cul-de-sac and convey the additional right-of-way associated therewith to the County. Once cul-de-sac has been constructed and the appropriate right-of-way conveyed the County will release its interest in the easement.

Charter Communications, Duke Energy, Florida Public Utilities, Frontier Communication, Summit Broadband, and Zayo Group have no objections to the proposed vacation. Lumen objected stating that the vacation area may be needed in the future but have no plans to utilize the area at this time, and this statement is a normal response from this company.

The Roads and Drainage Division, Office of Planning and Development, and Utilities Division have no objections to the proposed vacation.

RECOMMENDATION

Request Board adopt a resolution to vacate a portion of maintained right-of-way for Holly Hill Grove Road 1, as shown on the Plat of Holly Hill Grove & Fruit Co. and on Maintained Map Book 23, Pages 21 through 25 in Davenport, Florida, as more fully described in the legal description attached to the Petition and Resolution attached hereto. Also request Board accept the Easement from Circus Inn, Inc
