DESCRIPTION

The School Board of Polk County is requesting the partial vacation and annulment of Poinciana Subdivision Neighborhood 3 West Village 8, a recorded subdivision plat, to remove the portion of the plat acquired by the School Board for the development of a new high school (see attachments #1-10). The School Board purchased the property from KK Cattle in March 2026, and the School Board is the fee-simple owner of the area proposed for vacation. KK Cattle Company has provided written consent to the proposed partial plat vacation and acknowledges and agrees to the resulting boundary configuration (see attachment #8).

 

The applicable utility providers have been notified of the request, and no objections have been received (see attachments #11-15). The proposed vacation will not affect the ownership or right of convenient access of other property owners. The proposed high school will obtain access from Bayberry Street, while the remaining portion of the original plat has other access points to County rights-of-way. The proposed vacation does not adversely affect existing or planned roadway connections. The parcel to the south of the area is owned by the Board of Trustees of the Internal Improvement Trust Fund of the State of Florida. Staff has determined that the proposed plat vacation does not adversely affect surrounding properties or identified public interests.

 

The Board is considering this request pursuant to Florida Statutes, including Sections 177.101 and 336.09-12. These sections govern the vacation and annulment of recorded plats and the treatment of streets and rights-of-way. The proposed action will vacate and annul the identified portion of the recorded plat in accordance with the applicable statutory requirements.
