DESCRIPTION

The County has received the following requests to adopt resolutions vacating, abandoning, discontinuing, closing, renouncing, and disclaiming any rights of the County or the public in certain platted and unmaintained rights-of-way, maintained right-of-way and a platted drainage easement. Florida Statutes, Section 336.10, requires the Commissioners hold a public hearing to consider Petitions adopting resolutions vacating, abandoning, discontinuing, closing, renouncing, and disclaiming property under their control. Setting a public hearing date will comply with Florida Statutes and allow the request to be considered.

 

Request Board set a public hearing date for the following requests to vacate platted and unmaintained rights-of-way, maintained right-of-way and a platted drainage easement. Suggested Hearing Date: Tuesday, July 16, 2024 at 9:00 a.m., or immediately following the regular agenda:

 

1.                     Consider a petition by Abdul Alkadry, P.E., as authorized agent for GLK Real Estate, LLC, to adopt a resolution vacating various platted and unmaintained rights-of-way lying within, or adjacent to, Section 14, Township 27 South, Range 27 East, as shown on the map of Florida Development Co Tract recorded in Plat Book 3 at Pages 60 through 63 and on the Replat of Lakewood Heights recorded in Plat Book 26, at Page 16, both of the Public Records of Polk County, Florida. 

 

2.                     Consider a petition by Thomas Wodrich, as authorized agent for Susan Carden, to adopt a resolution vacating a portion of a platted public Drainage Easement over Lot 13, as shown on the plat of Country View Estates II, recorded in Plat Book 84 at Pages 8 through 11, Public Records of Polk County, Florida.  The subject easement lies in Section 19, Township 27 South, Range 23 East.

 

3.                     On Board’s Motion, consider a request to adopt a resolution vacating a portion of maintained right-of-way for Shady Oaks Drive as recorded in Map Book 25, at Pages 28 through 35, Public Records of Polk County, Florida.  The subject right-of-way lies in Section 33, Township 30 South, Range 31 East.

 

4.                     Consider a petition by David Carter, as authorized agent for Nim Lithuel, LLC and C.C. Calhoun, LLC, to adopt a resolution vacating platted and unmaintained rights-of-way as shown on the map of Starr Lake Development recorded in Plat Book 6, at Page 2 and on the Replat of Starr Lake Development recorded in Plat Book 6, at Page 12, both of the Public Records of Polk County, Florida.  The subject rights-of-way lie in Section 13, Township 29 South, Range 27 East.

 

RECOMMENDATION

Request Board set a Public Hearing on Tuesday, July 16, 2024 at 9:00 a.m., or immediately following the regular agenda, to consider the preceding items.
