DESCRIPTION

The County has received a petition from Steven and Bobbie Anderson, to vacate any public interest the County may have in a 30-foot-wide strip of land lying south of Herndon Road and adjacent to the west of their property identified as Parcel ID Number 273005-000000-011120.  The subject area lies in Section 05, Township 30 South, Range 27 East.

Herndon Road is an unpaved, dead-end, County maintained roadway running south off of Old Bartow/Lake Wales Road.  In 1982 a maintained right-of-way map was filed for Herndon Road recorded in Map Book 7, at Pages 31 delineating the County’s maintenance limits which extends approximately 900-feet south of Old Bartow/Lake Wales Road.  The Property Appraiser tax maps depict a 30-foot wide strip of unassessed property which runs south of, and beyond, the limits of the maintained right-of-way map by approximately 420-feet.  However, no evidence could be located showing that the strip was ever conveyed or dedicated to the County or the public.  Additionally, it appears that the County is not currently maintaining the portion of Herndon Road beyond the limits of the map.  The petitioners are requesting the vacation to remove any public interest that may exist in that portion of the 30-foot wide strip lying adjacent to their property to allow for the installation of a gate to secure the entrance to their property. Vacating the subject area would remove any public interest that may exist in the strip of land in an effort to allow the owners to assemble it with their property.

Florida Public Utilities and Frontier Communications have no objections to the proposed vacation. Duke Energy has requested a utility easement for existing utilities location within the vacation area and the petitioners have complied with its request.

The Roads and Drainage Division, Office of Planning and Development, and Utilities Division have no objections to the proposed vacation.

RECOMMENDATION

Request Board adopt a resolution to vacate any public interest which may exist in a above-mentioned portion of a 30-foot-wide strip of land, as more fully described in the legal description contained in the Petition and Resolution attached hereto.
