DESCRIPTION
Request the Board, by its own motion, vacate a portion of deeded and maintained right-of-way for Mosely Road, as well as portions of a public road reservation. The County recently completed a project to realign a portion of a County maintained dead end roadway known as Mosley Road near its northern terminus. The realignment will eliminate several hundred feet of roadway that is not needed and, through coordination with the City of Lake Alfred, will allow for an emergency connection to Mosley Road from a planned residential development located to the north. To accommodate the realignment additional right-of-way was needed from an adjacent property owner. As part of the agreement with the owner, approved by the Board in February 2023, for the additional right-of-way the County agreed to process, by Board’s own motion, a request to vacate the existing right-of-way lying to the east of the realignment which is no longer needed. The requested vacation area includes that portion of deeded right-of-way for Mosley Road as described in that certain Quit Claim Deed recorded in O.R. Book 261, at Pages 56 and 57 lying east of the realignment area. In addition, the plat of Camp Monson, filed in 1929 in Plat Book 28, at Page 25, depicts areas identified as “15’ reserved for county road” which appear to be a reference to a reservation of 15-foot strips for public highway purposes first found in a deed filed in 1925 in Deed Book 292, at Page 555. A portion of said reservation area lying east of the realignment is included in the proposed vacation area as well as a portion of said reservation area lying west of the realignment which was previously vacated by the City of Lake Alfred and is being included to release any potential interest the County may have in the area. Vacating the rights-of-way and reservation areas will remove the public’s interest in the subject areas which will allow the adjacent property owners to assemble with, and fully utilize, the areas.
The City of Lake Alfred, Florida Public Utilities, Frontier Communications, and Summit Broadband were contacted and have submitted no objections.
The Roads and Drainage Division, Office of Planning and Development, and Utilities Division have no objections.
RECOMMENDATION
Request Board adopt a resolution to vacate a portion of deeded and maintained right-of-way for Mosley Road, as well as the above mentioned reservation areas shown on the Plat of Camp Monson, as more fully described in the legal description contained in the resolution attached hereto.
FISCAL IMPACT
No fiscal impact.
