SUBJECT
title
Declare surplus and authorize the public sale of County-owned remnant right-of-way parcels associated with the West Pipkin Road Project, Parent Parcel ID Numbers 232911-000000-043160/043180/043210/043240. (Potential for $95,000 or greater, one-time revenue)

DESCRIPTION
The County acquired multiple residential lots lying adjacent to the south side of W. Pipkin Road and to the east of Fairfield Drive in conjunction with a project to four-lane a roadway known as the W. Pipkin Road Improvement Project. The County negotiated the purchase of the lots in their entirety due to impacts to the properties by the project. The project has been completed and the necessary right-of-way for the completed roadway has been excluded which resulted in small remnant parcels which are no longer needed by the County; however, Polk County Utilities has requested the reservation of an easement over the northern portion of the property for the maintenance of a sanitary sewer force main located along the roadway adjacent to, or near, the subject property. Individually, the remnant parcels are not buildable; however, they are contiguous parcels and collectively total approximately 27,278 square feet. The County hired an independent appraiser to establish a market value for the consolidated remnant parcel and a value of $95,000 was established. In an effort to reduce the County’s Land Inventory, staff is requesting the Board to declare the parcels surplus and to authorize the public sale of the remnant parcels, as a single unit, to the highest bidder whose bid meets or exceeds the minimum bid amount and approve the appraised amount of $95,000 as the minimum bid.
Florida Statutes allow for the disposal of County-owned real property by declaring the property surplus and authorizing a public sale to the highest bidder. Declaring the subject parcel surplus and authorizing its sale will allow the public to purchase the parcel, place it back on the tax roll, remove the property from the County Land Inventory and allow the County to cease maintenance activities associated with the parcel.
RECOMMENDATION
Request the Board declare County-owned remnant parcel described above surplus and authorize its public sale to the highest bidder at or above the minimum bid amount. Also, request Board approve the minimum bid amount of $95,000 for the purchase of the property with the condition that the recording fees and documentary stamps shall be borne by the prospective buyer. Ownership of the properties will be transferred in “as is” condition and conveyance will be by County Deed with a reservation for a utility easement.
FISCAL IMPACT
Proceeds from the sale of the parcel to be deposited into the appropriate fund, to be determined by Finance and Accounting.
