DESCRIPTION
The County has a project known as the Rolling Oak Estate Drainage Project, to improve drainage in the area of Glenview Drive within Rolling Oak Estate (the "Project"). The Project consists of construction of an inlet, riprap, drainage pipelines and swales within the boundary of the Owners' property. The engineering for the project has identified properties owned by Lee H. Hart and Margie V. Hart and Mohamed S. Alli requiring drainage easements for the project.
To accommodate the construction associated with the Project, the County has requested easements from adjacent owners. The Harts have agreed to the County's request for easement after their attorney reviewed the plans for the project. Subsequent negotiations with the owner's attorney have resulted in proposed settlement of attorney fees in the amount of $3,800. The Hart's have executed and delivered the Drainage Easement to the County as requested in the Agreement. Mr. Mohamed S. Alli has agreed to the easement request and has executed and delivered a Drainage Easement to the County.
The County Attorney's Office and the Real Estate Services Director have reviewed the agreement and recommend approval. Approving the Agreement, authorizes the issuance of funds for the attorney review fees and costs to the firm of Lowndes, Drosdick, Kantor and Reed, P.A. Accepting the Drainage Easements will allow the County to move forward with the proposed drainage improvements in an effort to alleviate flooding concerns in the area.
RECOMMENDATION
Request Board approve the above-mentioned Agreement and authorize the issuance of funds in the amount of $3,800 for attorney review on behalf of the owners Mr. and Mrs. Hart to Lowndes, Drosdick,...
