Authorize an Access and Maintenance Easement to 7X Collective, LLC for access over the Wahneta Farms Drainage Canal. (No fiscal impact)

DESCRIPTION
7X Collective, LLC (“7X”) is the contract purchaser of a tract of land located near the end of a County maintained roadway known as 17th Street to the west of Rifle Range Road in the Wahneta area. 7X contacted the County regarding access to the property containing approximately 37-acres which does not have public road frontage and is only separated from the public road right-of-way for 17th Street by the Wahneta Farms Drainage Canal. 7X has prepared plans for a proposed driveway with a culvert and has requested an easement from the County to allow for access over the canal. The Roads and Drainage Division has reviewed and approved the plans for the proposed driveway and culvert under the condition that it be constructed and maintained by the property owner and not the County. An Access and Maintenance Easement has been prepared which would give 7X access over the canal provided it takes ownership of the property within ninety days and would make them responsible for the construction and maintenance of the driveway and culvert. Authorizing the Access and Maintenance Easement would allow 7X to construct a driveway to access its property over the drainage canal.
RECOMMENDATION
Request Board authorize the afore-mentioned Access and Maintenance Easement.
