DESCRIPTION
The County received a petition from Kelly L. Yudichak, to vacate portions of platted, unopened, and unmaintained right-of-way shown on the plat of Leisure Shores recorded in Plat Book 46, Page 4, and shown on the Revised Map of Lake View recorded in Plat Book 3, Page 80 of the Public Records of Polk County, Florida. The subject rights-of-way lies in Section 07, Township 28 South, Range 26 East.
The plat of Leisure Shores, filed in 1962, dedicated to the public various rights-of-way throughout the plat. One such right-of-way is a 35-foot wide unnamed and unmaintained right-of-way lying to the North of Lot 13, of Block 5 of Leisure Shores which includes, and therefore replatted, the southerly half of a 30-foot wide platted right-of-way shown as Marianna Street on the Revised Map of Lake View, recorded in Plat Book 3, at Page 80 which is presumed to be dedicated to the public due to the lack of a dedication to the contrary. The Petitioner owns said Lot 13 and has requested the vacation of the platted right-of-way lying to the north of her property, which consists of the 35-foot wide platted right-of-way described above from the Leisure Shores plat along with the remaining 15-foot wide platted right-of-way shown as Marianna Street on the Revised Map of Lake View, in order to better secure her property against trespass. The property owner adjacent to the north of the subject vacation area, Joann Bissett Knapek, has consented to the vacation, and through coordination between the two property owners has agreed to convey her resulting interest in the vacation area to the Petitioner and has agreed to grant an easement to the County...
