The HOA is seeking to place minimal landscaping in portions of the County right-of-way along Myrtle Road, Myrtlebrook Drive, Evergreen Meadows, and Flowering Shrub Street.

DESCRIPTION
This is a request from the Myrtlebrook Preserve Homeowners Association (HOA) to enter into a landscape maintenance agreement with Polk County for the placement of minimal landscaping within portions of the County right-of-way along Myrtle Road, Myrtlebrook Drive, Evergreen Meadows, and Flowering Shrub Street.
By entering into this agreement, the HOA acknowledges and understands that the County, at any time, may remove, relocate, or adjust any or all landscaping improvements (without any reimbursement) under this agreement for the County’s future purpose of widening, improving, altering, or making any necessary changes to the County’s right-of-way. The agreement has been reviewed and approved by the County Roads and Drainage Division staff and County Attorney’s Office.
RECOMMENDATION
Staff recommends approval of the Landscape Maintenance Agreement with the Myrtlebrook Preserve Homeowners Association.
