DESCRIPTION
On September 22, 2023, Polk County filed a Verified Complaint for Temporary and Permanent Prohibitory Injunctions, Case No. 2023CA-6073. Mediation has been set in this matter. Florida Rules of Civil Procedure, Rule 1.720(d) states if a party to mediation is a public entity required to operate in compliance with chapter 286, Florida Statutes, that party is deemed to appear at a mediation conference by the presence of a representative with full authority to negotiate on behalf of the entity and to recommend settlement to the appropriate decision-making body of the entity.
RECOMMENDATION
Authorize Deputy County Manager, John Bohde to negotiate on behalf of Polk County and to recommend settlement to the Polk County Board of County Commissioners in cases involving WHS Visions of Lakeland, LLC or BS Ranch and Farm, Inc. including, but not limited to, Case No. 2023CA-6073.
