DESCRIPTION

This is a County-initiated text amendment to Chapter 9 that modifies the County’s compatibility review procedures to comply with the residential compatibility requirements established by HB 399. The amendment adds requirements for identifying specific areas of incompatibility, considering feasible mitigation measures, and documenting the basis for a compatibility-based denial. It also clarifies that compatibility concerns may be addressed through conditions of approval and incorporates the statutory limitations applicable to residential compatibility reviews. On October 7, 2026, the Planning Commission recommended approval of the amendment (Vote: 7-0).

Section 163.3202, Florida Statutes (F.S.) requires the Board to adopt Land Development Code (LDC) regulations consistent with the implementation of the Polk County Comprehensive Plan.  Amendments to the LDC require two public hearings before the Board to be adopted.

RECOMMENDATION

Request Board set hearing for the first reading on November 3, 2026, at 9:15 a.m. and the second reading on December 1, 2026, at 9:15 a.m.
