DESCRIPTION
The County has a project to improve drainage on and around Imperial Lakes Boulevard which consists of, among other things, constructing a storm water retention storm pond. In July 2023 the County acquired a parcel for the storm water pond; however, the parcel is irregularly shaped and does not allow for the most efficient design of a storm water pond. At the time, and until recently, the adjacent property was involved in litigation and the County could not acquire additional land to accommodate a more efficient design of the pond. The litigation on the adjacent property has subsequently been resolved and the property has recently changed hands. Discussions with the new owner of the property, The Villages at Imperial Lakes, LLC ("Villages"), have resulted in a proposal to exchange portions of the County owned property which are not needed for the drainage project for portions of the Villages property to allow for a more efficient pond configuration. Pursuant to Florida Statutes, the Board of County Commissioners is authorized to exchange County property, not needed for County purposes, for other property when it is in the best interest of the County to do so. The Villages has executed a Land Exchange Agreement to convey two parcels identified as Parcels 100 and 101 to the County in exchange for two parcels identified as Parcels 300 and 301.
The County Attorney's Office and the Real Estate Services Director have reviewed the agreement and recommend approval. Approving the Agreement and adopting a resolution authorizing the exchange of real property will give the County the property needed to reconfigure the storm water pond in a more efficient manner.
