DESCRIPTION
The County has received a petition from Barbara Monday, to vacate a portion of deeded, right-of-way for Johnson Road, lying adjacent to the east of Parcel ID Numbers 252720-000000-021050/022020. The subject right-of-way lies in Section 20, Township 27 South, Range 25 East.
Right-of-way for Johnson Road was conveyed to Polk County through a series of Quit Claim Deeds with the southern portion being conveyed in 1971 by a Quit Claim Deed which was recorded in Official Records Book 1338, at Pages 855 and 856, Public Records of Polk County, Florida. Johnson Road is a paved roadway which is maintained by the County; however, the roadway stops short and does not extend into the right-of-way which lies adjacent to Parcel ID Numbers 252720-000000-021050/022020 which are owned by the Petitioner. Based on historic aerials it does not appear that the subject portion of the right-of-way has ever contained a roadway or been maintained by the County. The petitioner is requesting the vacation to remove the public interest in the area and allow for the future development of two residential homesites via an access easement. The owners of the two properties adjacent to the east of the subject area were contacted and one of the owners objected; however, she currently has, and is utilizing, legal access from Berkley Road to the east. Vacating the subject right-of-way will remove the public interest in the subject area and allow the petitioner to move forward with its development plans.
Frontier Communications, Charter Communications, City of Auburndale (water/sewer), Gulfstream Natural Gas System and MCI have no objections to the proposed vacation. Tampa Electric Company requested an easement over the vacation area for existi...
