DESCRIPTION
In 1965 the Legislature of the State of Florida enacted Chapter 65-2130, Laws of Florida, prohibiting the Clerk from recording any deed, easement or other document conveying an interest in lands to Polk County unless it has been approved by the Board of County Commissioners. The Law allows for, among other things, an endorsement via a signature on the conveyance document by an officer of the County as authorized by the Board in lieu of an individual resolution for each conveyance. Since the enactment of this law the County has utilized this option to evidence that a conveyance document has been approved by the Board. Early recorded documents following this law show that the documents were endorsed by the County Engineer; however, the organizational structure for the staff responsible for recording conveyance documents has changed multiple times over the intervening years. The Real Estate Services Division is currently tasked with processing documents, or property agreements, for Board approval and for the subsequent recording of the conveyance documents. In an effort to clarify the appropriate endorsement authority for the division responsible for processing conveyance documents it is request that the Board adopt a resolution authorizing the Real Estate Services Director, or the Deputy County Manager in the event that the Real Estate Services Director is unavailable, to endorse conveyance documents which have been approved by the Board and conveyance documents associated with agreements that have been approved by the Board. Authorizing the Real Estate Services Director, or Deputy County Manager, to endorse the above-mentioned conveyance documents to the County will allow for their recordation under the current law.
